The Gujarat High Court lifted ban on the controversial book written by expelled BJP leader Jaswant Singh. The state government had imposed ban immediately after the release of book which was challenged by two social activists Manish Jani and Prakash Shah.
The State Government had issued a notification on August 19 banning Singh's book 'Jinnah-India Independence Partition'. The state government claimed that the book was against 'national interest' and that the contents were 'misleading'.
In its ruling today the court said that the notification to ban the book does not satisfy the requirement under CrPC. The court also observed that the ban has amounted to curtailment of Fundamental Rights.
Revoking the ban, the High Court stated that the Government cannot be allowed to issue a fresh notification as it was silent on how it would affect national interest and communal harmony.
