Court allows Narco test on Aarushi's parents

CBI on Tuesday obtained the permission from a special court in Ghaziabad to conduct Narco analysis test on Arushi's parents - Rajesh and Nupur Talwar. The 14 year old Arushi was killed at her Jalvayu Vihar residence in Noida on May 16, 2008 along with Dr. Talwar's domestic help - Hemraj.

Brutal murder of Arushi and Hemraj made headlines for months in Indian Media because of the bizarre nature of the crime. And till date it remains a mystery how and why Arushi was killed and who killed Arushi and Hemraj.

Two weeks ago CBI filed an application in the court of Special Judicial Magistrate to obtain the permission to conduct Narco test and the Magistrate Preeti Singh on Tuesday allowed the agency to go ahead with it.

Before filing the application in the court the CBI had already obtained written consent from Dr. Rajesh and Nupur Talwar.

Experts conduct this test and sedate the subject with a drug which reduces the inhibitions of humans and their answers are believed to have become more truthful. However, any statement made under the sedated condition is not admissible in a court of law in India.

Supreme Court is yet to decide on the legality of the statements obtained through Narco Analysis test.

However, it is considered useful by investigating officials in obtaining important leads and additional information that may lead to solving the case.

Earlier Noida police had arrested Dr. Rajesh Talwar but CBI gave him the clean chit when it took over the case from Noida Police.

Dr. Rajesh told local media that CBI wanted to conduct the Narco test last year too and even at that time both he and his wife had consented for the test. However, CBI only conducted brain mapping and some other tests but did not carry out Narco analysis test.

Local media quoted Dr. Rajesh Talwar as saying, "Even now we have no problem with that."

Dr. Nupur Talwar, mother of Arushi also told local media, "CBI has again decided that they wish to put us through Narco test. The agency claims it is in the interest of justice for Aarushi. We have no problem with that. But CBI must get to the real culprits."
